The following terms and conditions, together with other policy documents they expressly incorporate by reference (collectively “Terms of Use”), govern your access to and use of the Website including any content, functionality, software, mobile applications, any services or offerings offered on or through the Website and any other services provided by the Company related to the Website as a registered user. As some of our services may be software that is downloaded to your computer, phone, tablet, or other device, these terms will also apply to the same.

By accessing and using the Site, and/or by enrolling in a course, you agree to each of the Terms of Use set forth herein. If you do not agree with any of the Terms of Use, you are not authorized to access or use the Site for any purpose. By using the Site you express your understanding and agreement to be bound by these terms. If you do not agree to all the terms and conditions of this agreement, please do not proceed. In that case, you must immediately stop using the Website and avoid using any content from the Website.

encertify.com reserves the right to modify the terms of use without prior notice.

1. Definitions

In addition to the terms defined throughout these Terms of Use, the terms "you", "your" and "yours" refer to the user, customer or purchaser utilizing this Site to obtain Services. The terms “Company”, "we", "us" and "our" refer to Encertify.com

2. Accessing the Website

This Site is intended for the lawful use of members of the general public who are over the age of 18 years. Access to the Website, is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Website without notice. We will not be liable if for any reason our site or associated mobile app is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.

You are responsible for making all arrangements necessary for you to have access to the Website. Your access and other activities relating to the Website must be in compliance with all applicable laws and regulations, including, without limitations, laws relating to copyright and other intellectual property use, and to privacy and personal identity. While accessing and using the Website as a registered user, you must not provide incorrect or false information; copy, distribute, modify, reverse engineer, deface, tarnish, mutilate, hack, or interfere with the products or operation of the Website; frame or embed the Website or products; impersonate another person or gain unauthorized access to another person's Account; introduce any virus, worm, spyware or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment, or any other aspect of the products or operation of the Website; scrape, spider, use a robot or other automated means of any kind to access the products.

3. Users Registration and Subscription

When you register for a course or subscribe a service provided on the Website, the information you provide to us during the registration process will help us in offering content, customer service, and network management. You are solely responsible for maintaining the confidentiality of your account, username, and password and for all activities associated with or occurring under your registered account. You represent and warrant that your Account information will be accurate at all times. You must notify us (a) immediately of any unauthorized use of your Account and any other breach of security, and (b) ensure that you exit from your account at the end of each use of the Website. To the extent permissible under applicable law, we cannot and will not be responsible for any loss or damage arising from your failure to comply with the foregoing requirements or as a result of use of your account, either with or without your knowledge, prior to your notifying us of unauthorized access to your account.

You must not transfer your Account to any other person and you must not use anyone else's account at any time without the permission of the account holder.

4. Content, Licenses & Permissions

All software, technology, designs, materials, information, communications, text, graphics, links, electronic art, animations, illustrations, artwork, audio clips, video clips, photos, images, reviews, ideas, and other data or copyrightable materials or content, including the selection and arrangements thereof is "Content." Content remains the proprietary property of the Company or the person or entity supplying it (affiliates, partners and/or third party providers and suppliers) and is protected, without limitation, pursuant to U.S. and foreign copyright and other intellectual property laws.

All registered users will be granted a limited, non-exclusive, revocable, non-transferable, and non-sublicenseable right to access the content and the portion of the Website applicable to the registration type. By agreeing to grant such access, the Company does not obligate itself to maintain the Content or the Website, or to maintain the same in their present forms. The Company may upgrade, modify, change or enhance the Services and convert a registered user to a new version thereof at any time in its sole discretion, to the extent that this is not detrimental to user’s use of the Services and on reasonable prior notice to user (unless the change is of critical business importance or outside the Company’s control, in which case the Company will explain the reason for the changes as soon as is reasonably practicable).

All Registered Users and Subscribers agree to abide by any rules or regulations that the Company publishes with respect to conduct of users of the Website, which rules and regulations are hereby incorporated into these Terms of Service by this reference. The Company reserves the right to deny a user access to the Website if, in the Company’s sole discretion, user has failed to abide by these Terms of Service or appear likely to do so.

Users accepts that the Company in its sole discretion may, but has no obligation to, monitor the Services or any portion thereof, and/or to oversee compliance with these Terms of Use.

5. Fees and Payment

If you select to access or use products that involve payment of a fee, then you agree to pay, and will be responsible for payment of that fee associated with such access or use and that you have read, understood, and agree to be bound by the pricing information provided. Full payment is due at the time of registering for the paid courses or services. If you provide credit or debit card information to pay for such fees, then you hereby represent and warrant that you are authorized to supply such information and hereby authorize the Company to charge your card.

If your payment method fails or your account is past due, then we may collect fees owed using other collection mechanisms. This may include charging other payment methods on file with us and/or retaining collection agencies and legal counsel. We may also block your access to any products pending resolution of any amounts due by you to Company.

6. Intellectual property rights

The Website and the entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) are owned by the Company, its licensors or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. This Policy permits you to use the Website for your non-commercial use only. No right, title or interest in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted, are reserved by the Company.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Website, except as follows: (i) You may store files that are automatically cached by your Web browser for display enhancement purposes; (ii) if we provide desktop, mobile or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by an applicable end user license agreement for such applications; and (iii) if we provide social media features at any time, you may take such actions as are enabled by such features.

You may not: (i) use any illustrations, photographs, video or audio sequences or any graphics separately from the accompanying text; or (ii) delete or alter any copyright, trademark or other proprietary rights notices from copies of materials from the Website; or (iii) access or use for any commercial purposes any part of the Website or any services or materials available through the Website.

The Company name, the Company logo, and all related names, logos, product and service names, designs and slogans, are trademarks of the Company or its affiliates or licensors. You may not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs and slogans on the Website are the trademarks of their respective owners.

7. Copyright infringement

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement where appropriate. If you believe any materials accessible on or from the Website infringe your copyright, you may request removal of those materials (or access thereto) from the Website by submitting a written notification to Encertify.com. Please send an email to sup[email protected] with the details. The details should include:

  • Identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the Website, a representative list of such works.
  • Identification of the material you believe to be infringing, in a sufficiently precise manner to allow us to locate that material.
  • Adequate information by which we can contact you (including your name, postal address, telephone number and, if available, e-mail address).
  • A statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent or the law.

Upon receipt of such notification, Encertify.com will take necessary action within 15 working days.

8. Trademarks

The trademarks, service marks, and logos (the "Trademarks") used and displayed on the Website and content are our registered or unregistered Trademarks or of our suppliers or third parties and are protected pursuant to U.S. and foreign trademark laws. All rights are reserved and you may not alter or obscure the Trademarks, or link to them without our prior approval.

9. Limitation of Liability

You expressly agree that use of the Website, the Services, and the Content and Courseware are at your sole risk. We do not warrant that the Website or the Services or access to the Content and Courseware will be uninterrupted or error free; nor is there any warranty as to the results that may be obtained from the use of the Website, the Services or the Content and Courseware or as to the accuracy or reliability of any information provided through the Website, the Services, or the Content and Courseware. In no event will we or any person or entity involved in creating, producing, or distributing the Website, the Services, or the Content and Courseware be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use the Website, the Services, or the Content and Courseware.

The disclaimer of liability contained in this clause applies to any and all damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of records or any other material, whether for breach of contract, negligence, or under any other cause of action.

You hereby specifically acknowledge that we are not liable for any defamatory, offensive, wrongful, or illegal conduct of third parties, or other users of the Website, the Services or the Content and Courseware and that the risk of damage or injury from the foregoing rests entirely with each user.

In case of any disputes or perceived failure to provide service as agreed, Encertify will only be liable for the amount paid by the student towards the course enrollment. We will not be liable for any other expenditure or other incidental costs that a student may have incurred. The total value of reimbursement provided to a student by us will not, under any circumstances, exceed the amount that the student has paid for the course enrollment.

10. Submission of Information

Although we provide certain security in an effort to protect the electronic transmission of certain information that you submit to us through this Site, we do not guarantee the security of any information transmitted to or from this Site, including to or from any Third Party Websites linked to this Site. Submission of any financial (e.g. credit card) or other information to this Site or to any Third Party Websites linked to this Site is entirely at your own risk and responsibility. Do not send any confidential or proprietary information to us through this Site. Except for personal information about you, including financial/credit card information, any information you do send to us through this Site will be deemed NOT to be confidential ("Non-Confidential Information").

11. Agreement to Privacy Policy

By accessing this Site, you are consenting to the collection, use and disclosure of your personal information and to the terms of our Privacy Policy. If we decide to change our Privacy Policy, we will post the revised Privacy Policy prominently on this Site or otherwise bring it to your attention, so that you are always aware of what we do with your information.

We reserve the right to feature your picture in any photos, videos, or other promotional material used by us. Further, we may use your personal information to inform you about other certification training courses offered by us. However, we shall not distribute or share your personal information with any third party marketing database or disclose your personal information to any third party except on a case-to-case basis after proper verification of such third party or if required under any applicable law.

12. Miscellaneous

Entire Agreement: These Terms and any policies applicable to you posted on the Site constitute the entire agreement between the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter.

Indemnity: You agree to indemnify and hold us, our contractors, licensors, directors, officers, employees, and agents, harmless from and against any and all claims, losses, damages, liabilities, and expenses including attorneys' fees, arising out of your unauthorized use of the Website, the Services, and the Content and Courseware or any violation or breach of this Agreement or any provisions hereof.

Severability: If any provision of these Terms is found to be illegal, void or unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions of these Terms.

Waiver: A provision of these Terms may be waived only by a written instrument executed by the party entitled to the benefit of such provision. The failure of Company to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Notice: Any notice or other communication to be given hereunder will be in writing and given by facsimile, postpaid registered or certified mail return receipt requested, or electronic mail.

No Agency: Nothing in these Terms shall be construed as making either party the partner, joint venture, agent, legal representative, employer, contractor or employee of the other. Neither the Company nor any other party to this Agreement shall have, or hold itself out to any third party as having, any authority to make any statements, representations or commitments of any kind, or to take any action that shall be binding on the other except as provided for herein or authorized in writing by the party to be bound.

Changes to Terms of Use : Enertify.com reserves the right, at any time, to modify, add to, delete from, alter, or update these Terms of Use ("Changes"), and you agree to be bound by such Changes as are in effect at the time you use the site and/or enroll in a course. Changes shall be effective immediately upon publication thereof, which may be made by posting on this Site, or by electronic or conventional mail. Your use of this Site following any Changes constitutes your agreement to follow and be bound by these Terms of Use as published when you use the Site and/or enroll in a course.

Privacy Policy

We understand that privacy is important to users of our Site, especially when conducting business. We take your privacy seriously and are committed to protecting your right to privacy as a user of our website. We have made every effort to ensure your information is secure. This statement governs our privacy policies with respect to those users of the Site ("Visitors") who visit without transacting business and Visitors who register to transact business on the Site and make use of the various services offered by us (“Enrolled Users”).

Personally Identifiable Information (Personal Information)

Refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

Information Collected by Encertify and its vendors

We may collect basic user profile information from all of our Visitors. We collect the following additional information from our Enrolled Users: the names, addresses, phone numbers, email addresses, company name, and job title of users. We may also collect photos and LinkedIn profile information of our users.

In addition to our direct collection of information, our third party service vendors (such as credit card companies, clearinghouses and banks) who may provide such services as credit, insurance, and escrow services may collect this information from our Visitors and Enrolled Users. We do not control how these third parties use such information, but we do ask them to disclose how they use personal information provided to them from Visitors and Enrolled Users. Some of these third parties may be intermediaries that act solely as links in the distribution chain, and do not store, retain, or use the information given to them.

Customer’s Credit card information is never stored in our system as it is processed by our payment gateway which uses Secure Encryption Technology (SSL). Our primary payment processing partners are Stripe, PayPal, PayUMoney and CCAvenue.

Use of Personal Information

We use Personally Identifiable Information to customize the Site, to make appropriate service offerings, and to fulfill buying requests on the Site. We may email Visitors and Registered Users about research or purchase and selling opportunities on the Site or information related to the subject matter of the Site. We may also use Personally Identifiable Information to contact Visitors and Registered Users in response to specific inquiries, or to provide requested information.

Personal information like Name, Email Id, and Contact Number may be used to create login accounts for the user to access his/her enrolled courses. Since we use third party content for some of our courses, they will also have access these information when a user is registered in any of those courses.

We may use your information to contact you via email or telephone, typically to get feedback, to inform you about new products or provide support on your issues. If you do not want us to contact you via email, you can unsubscribe at any time.

We may publish User Name and other Personal Identifiable Information such as Photo, Company Name, and Job Title to showcase his/her review or feedback on certain products. We reserve the right to feature your picture in any photos, videos, or other promotional material used by us. If you do not want us to display your information in the website, contact us at [email protected].

Sharing of Information

We shall not distribute or share Personally Identifiable Information with any third party marketing database or disclose your personal information to any third party except on a case-to-case basis after proper verification of such third party or if required under any applicable law.

We may share aggregated information about our Visitors, including the demographics of our Visitors and Registered Users, with our affiliated agencies and third party vendors. We also offer the opportunity to "opt out" of receiving information or being contacted by us or by any agency acting on our behalf. Visitors and Registered Users may opt out of receiving unsolicited information from or being contacted by us and/or our vendors and affiliated agencies by responding to emails as instructed, or by contacting us at [email protected]

We have entered into and will continue to enter into partnerships and other affiliations with a number of vendors. Such vendors may have access to certain Personally Identifiable Information on a need to know basis for evaluating Enrolled Users for service eligibility. Since we use third party content / external trainer for some of our courses, they will have access to certain Personally Identifiable Information such as Name and Email Id, Phone Number and Address (in some cases), when a user is registered in any of those courses.

Our privacy policy does not cover their collection or use of this information.

Storing of Personal Information

Personally Identifiable Information collected by us is securely stored and is not accessible to third parties or employees of Encertify except for use as indicated above.

Cookie Information

In order to enhance your online experience and track website performance, our website uses cookies. It's a small text file which gets placed in your computer hard drive and can be retrieved later. Cookies do not tell us who you are.

Cookies are used to remember user preferences and maximize performance of our services. The information we collect with cookies is not sold, rented, or shared with any outside parties. Users who disable their Web browser's ability to accept cookies will be able to browse our Site but may not be able to successfully use our Service.

We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser's "help" file. Persistent cookies enable us to track and target the interests of our users to enhance the experience on our Site.

Third Party Cookies

We may from time to time engage third parties to track and analyze non-personally identifiable usage and volume statistical information from visitors to our Site to help us administer our Site and improve its quality. Such third parties may use cookies to help track visitor behaviour. Such cookies will not be used to associate individual Site visitors to any Personal Information. All data collected by such third parties on our behalf is used only to provide us with information on Site usage and is not shared with any other third parties.

All of our employees are familiar with our security policy and practices. The Personally Identifiable Information of our Visitors and Registered Users is only accessible to a limited number of qualified employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. While we take commercially reasonable measures to maintain a secure site, electronic communications and databases are subject to errors, tampering and break-ins, and we cannot guarantee or warrant that such events will not take place and we will not be liable to Visitors or Registered Users for any such occurrences.

Changes to Privacy Policy

These privacy policy terms may change time to time and we reserve the right to change the terms of the privacy policy at any time. We will let our Visitors and Enrolled Users know about changes to our privacy policy by posting such changes on the Site.

Refund Policy

This refund policy is governed by the terms and conditions mentioned in the Cancellation Policy.

For Online/Self-Paced Courses:

Raise refund request within 12 hours of purchase of course. No refund is provided if cancelled after 12 hours of enrollment or if the participant has accessed any of the course content or downloaded study guide(s).

For Classroom and Instructor-Led Training:
  • 100% refund will be provided when Encertify cancels a program and none of the available options suites the delegate.
  • 70% of the course fee will be refunded, if a delegate cancels his/her enrollment at least 7 days prior to the course start date.
  • No refund will be provided if a delegate cancels his/her enrollment within 7 days of course start date.

Note: Without any prior notification or update to our support/sales team, if a delegate does not show up on the first day of the training on time, their enrollment would be considered to be cancelled. They would not be entitled for any refund in this case too.

For Duplicate Payment:

Refund of the duplicate payment made by the delegate will be processed via the same mode of payment in 7 to 10 working days post intimation by the customer.

Note: Refund request can be initiated by sending an email to [email protected]. All refunds will be processed within 7-10 working days after the refund request is approved by Encertify.

Rescheduling Policy

If for some unforeseen reasons, a delegate wishes to reschedule his/her registration to a different date, a rescheduling fee is charged to cover our administration expenses. The following rescheduling policy applies in this case:

  • If the rescheduling request is received 7 or more days prior, 10% of course fee will be charged.
  • If the rescheduling request is received less than 7 days prior to the training commencement, no rescheduling will be allowed. However, the delegate can send a replacement instead.

The additional rescheduling charges should be paid to Encertify within 7 days of receipt for a course rescheduling request. Please note that rescheduling will be subject to availability of seats.

Cancellation Policy

a) If a classroom program or live online session is cancelled by Encertify

Encertify reserves the right to postpone/cancel a classroom course or a live online session, or change the location of a classroom training in an event of insufficient enrollments, instructor illness or force majeure events like floods, earthquakes, political instability, etc. We will make all reasonable efforts to reschedule a cancelled class and a delegate will have the following options to choose from:

  • The delegate can choose to attend the training program on the rescheduled date(s).
  • In case a classroom program is cancelled, the delegate would have the option of attending the same training program in any other location on any scheduled date or may opt to attend a live online session (if available).
  • 100% refund, if none of the above options suites the delegate.
b) If a classroom or live online course enrollment is cancelled by Delegate

If a delegate cannot attend a classroom training program or a live online session because of some unavoidable reason(s), we encourage the delegate to reschedule his/her enrollment to some other dates rather than cancelling the enrollment (refer to rescheduling policy). The delegate, if he/she so wishes, can send a replacement as well. However, this should be intimated to Encertify at least 2 days prior to the scheduled event. If the delegate decides to go ahead with the cancellation, the following terms will apply:

  • If the cancellation request is received 7 or more days prior to the course starting date, 70% of the course fee will be refunded. 30% of the course fee will be charged as administrative expenses.
  • No cancellation allowed within 7 days of commencement of the course. If the cancellation request is received less than 7 days prior to the training commencement, no money will be refunded.

Note: Without any prior notification or update to our support/sales team, if a delegate does not show up on the first day of the training on time, their enrollment would be considered to be cancelled. They would not be entitled for any refund in this case too.

c) If an online course enrollment is cancelled by Delegate

If a delegate wants to cancel his/her enrollment in an online course, the following terms will apply:

  • If the delegate intimates us about the cancellation within 12 hours of his/her enrollment into the online course, the delegate will be entitled for 100% refund of the course fee minus the payment gateway transaction fee, provided he/she has not accessed the online course. Both of our payment gateways, PayPal and Stripe charge a non-refundable transaction fee. While refunding, we will deduct this amount from the total amount paid by the delegate.
  • If cancelled after 12 hours of enrollment, no refund will be provided.
  • Once an online course is accessed, no refund will be provided. Since we collaborate with various content partners, we need to pay to our content partners once an online course access is provided to a delegate.
